Michael Donovan: Political Sortition for an Evolving World

Michael Donovan has written his Master’s thesis about sortition:

Abstract
Our Western political systems are straining to prove their legitimacy partly because the internet generation demands both open information and a role in the decision making. Yet, electoral democracy may be incapable of evolving to meet those requirements. This paper looks at sortition, or the selection of decision makers by lottery, to supplement or to replace current representative democracy. Empowering a cross-section of society to make policy decisions would more directly address the interests and concerns of the populace, and would result in an egalitarian and inclusive body, more transparent and resistant to corruption than are current policy makers. Furthermore, diverse assemblies possess greater ability in solving difficult problems and in making accurate forecasts than do the more homogeneous groups that currently comprise governing parties. Consensus building increases this innovative potential. With the proper application of sortition and deliberation, therefore, advancement in the common good can be accelerated.

Representation in the electoral system

Theoretical considerations show that the electoral system cannot be expected to produce government that represents the values and interests of the general public. The two mechanisms advanced for the idea that the electoral system is representatives – the virtue based mechanism and the rewards based mechanism – both do not withstand scrutiny. The widespread support for the 2011 anti-government protest movement in the West indicates that in many countries the public sentiment is that government is indeed not representative.

In a 2005 paper called “Inequality and democratic responsiveness” Martin Gilens makes an empirical study of representativity:

Abstract By allowing voters to choose among candidates with competing policy orientations and by providing incentives for incumbents to shape policy in the direction the public desires, elections are thought to provide the foundation that links government policy to the preferences of the governed. David Graeber is an

American anthropologist, political activist and author. He is currently reader in social anthropology at Goldsmiths College, University of London, and was formerly an associate professor of anthropology at Yale University. David is a member of the labour union Industrial Workers of the World, and has played a role in events such as the 2002 New York protests against the World Economic Forum. His most recent book is Debt: The First 5,000 Years (2011)

He is also described as

a man of many talents. A longtime activist, a professor of anthropology at the University of London, and a prolific author, David also helped found the Occupy Wall Street movement in 2011. He even coined the phrase “We are the 99%.”

On a Lighter Note…

Google alerts brought this to my attention. The same paper (with no author indicated) can be found at http://www.handmenotes.com. At first, I thought someone had written some kind of working paper on my work. But it looks like this is intended for use by students trying to cheat on a term paper assignment. I had no idea that enough professors were assigning my work as to justify circulating a paper like this. I’m deeply touched.

Poulin-Litvak: Sortition as a means to fight corruption

A new paper by David Poulin-Litvak has the following abstract:

Electoral democracy is in crisis. The use of sortition in our political systems could be a key to renewing and deepening democracy. But how to do so? And where to start? In this paper, I explore the idea that using sortition to address the problem of corruption could be a first step. Why? For two reasons. First, corruption of elected officials is an internal inconsistency of electoral democracy – it cannot be resolved adequately through electoral institutions. Second, there is also a large consensus on the fact – everybody agrees – that corruption is a problem.

I suggest granting the power to convene an Investigation Commission to a randomly selected citizen body. This body should also nominate the Commission’s head and receive its recommendations. I also discuss the idea of a Citizens’ Court to directly address the problem of corruption of elected officials. This broad jury would judge and sanction corrupted elected officials. Taking Quebec’s ongoing corruption saga as an example, I also try to see how the system would work in reality and, finally, where the system, once put into place, could lead to.

ParPolity

Tomas Mancebo wrote to point out a proposal for a constitutional system by Stephen Shalom called Participatory politics, or ParPolity, which contains a sortition-based element.

The main part of the proposal is a “nested councils” structure – a standard proposal of a hierarchical structure of elected bodies where each body elects a representative to a higher-level body:

Unlike typical direct elections, a good political system must give people an organic connection to those they elect so they can adequately monitor their performance and remove them when necessary. There cannot be large or remote constituencies that render monitoring impossible or even burdensome.

Unlike typical indirect elections, a good political system must ensure that the people’s will does not get attenuated through each intermediate level of voting.

“Absolutely fundamental deficits in understanding”

A British judge was very unhappy with the jury in a high-profile trial last week:

Vicky Pryce, the ex-wife of the disgraced cabinet minister Chris Huhne, faces a retrial next week over taking speeding points for him because a jury failed to reach a verdict, after suffering what the judge described as “absolutely fundamental deficits in understanding”.

The Guardian seemed to concur:

Mr Justice Sweeney discharged the panel of eight women and four men following more than 15 hours of deliberations, and a day after they submitted 10 questions that indicated they had not grasped the basics of their task,

but assembled a set of professionals defending the jury institution:

Beyond the principle of distinction

The primary negative effect of the electoral system is the obverse of its ostensible function. This effect is what Bernard Manin called “the principle of distinction” – the delegation of political power to people whose situation and outlook is significantly different from those of the population at large. As a result of this difference, the political elite serves interests that are different from, and often antithetical to, those of the average voter.

However, the electoral system is often presented by academic advocates and by electoral activists and politicians as providing a value to society above and beyond its function for selecting government officials. It supposedly encourages meaningful popular participation in government through voting, informed discussion, organized activism in electoral campaigns and awareness of the importance of compromise and coalition building. In fact, the electoral system encourages none of those patterns – on the contrary: it is antithetical to them. This is due to several characteristics of the electoral system that are not consequences of the principle of distinction.

  1. Politics as competition The electoral system is a mechanism in which groups compete for power. Allocation of power through competition has several related effects:
    • When political power is gained through competition, its attainment comes to be seen, primarily by the winners themselves but by others as well, as a reward. Corruption – use of the hard won political power to further the interests of the winners and their associates – then becomes a natural consequence of the achievement.
