Sortition, or the selection of political officers by lot, has its antecedent in the direct democratic tradition of ancient Athens. Its transfer into a modern context of representative democracy poses rightful scepticism not only about the practical difficulties, but more so about the theoretical inconsistencies that arise. Modern systems of political representation are based on the aristocratic idea of ‘government by the best’, who are to be selected through a competitive call for candidates (Manin 1997). Sortition, on the other hand, replaces this aristocratic criterion of competition and evaluative election with the democratic mechanics of direct and equal distribution of political office by chance. Hence, the very expression ‘democratic (s)election’ includes a paradoxical contradiction in terms, between the democratic concept of equal access to public office and the aristocratic idea of government by the (s)elected best.
My aim in this chapter is to shed some light into this contradiction by critically discussing the benefits and pitfalls of using sortition today, comparing it throughout the chapter with voting and the general effects of electoral representation. More specifically, my arguments are divided in four sections. I begin by addressing the reasons that drive klerotarians away from electoral representation (1). Next, I consider alternative modes of political ‘outsourcing’, such as the inclusion of civil society actors or the use of quotas (2). I continue by discussing the democratic legitimacy of sortition by dividing the subject in two questions: (a) political equality and (b) political participation (3). Last, I focus on the type of political representation that the lot produces, viewed from the perspectives of descriptiveness, authorization and accountability (4). In conclusion, I suggest that lotteries may offer valuable improvement to current practices of democratic selection, but only if special measures are taken to compensate for the limitations they entail.

In an article in The Conversation, Janosch Prinz and John Garry, both from Queen’s University Belfast, advocate for legislation by ad-hoc allotted bodies.
They start off by recounting a standard list of instances of electoral disfunction:
Many will agree that, in practice, democracy leaves a lot to be desired. The system often falls short of its ideals: whether it’s the US congress causing a total government shutdown; Australian prime ministers being ousted by internal party politics; or the UK’s disproportionate electoral system allocating only one seat to a party which received close to 4m votes.
This misses the point. None of these examples is an indication of a problem inherent in elections. The problem with electoralist systems is not that they don’t function but that they function in favor of electoral elites and their allies rather than for the average person.

In June 1998 Filip Palda, an economist who seems to have been at the time preoccupied with proposing democratic reforms, published an article in The Next City magazine in which he advocated the introduction of a plebiscitary mechanism to Canada. In the article, Palda recounted the standard arguments for “direct democracy”.
Under the present all-or-nothing approach to selecting government policies, the benefits of political specialization are lost. Most governments campaign on a bundle of services that includes health, education, welfare, transportation, the environment, and security. One party may be good at protecting the environment, but terrible at health care. Its rival may be good at health care but reprehensible on the environment. Instead of voting for a party while holding our noses, unbundling public services allows us to vote with a clear conscience, at all times. […]
Direct democracy — any form of voting that bypasses representatives — has another benefit, too; it allows voters to correct individual laws that representatives have passed to their detriment, without getting rid of the government. In April, hepatitis C victims lost their claims for compensation in our federal Parliament, their appeals falling on the deaf ears of a government riding high in the public’s esteem. If Canadians had the right of initiative, they might have succeeded in repealing the law, giving the public both the government and the laws it wanted, without the anguish that followed.[…]
Referendums and initiatives cut these middlemen out of power and let people decide issues for themselves. It is also natural for the public to continue its methodical, cautious, centuries-old drive for greater political freedom. They temper democracy’s worst aspects — the unaccountability of politicians — and bring out what is ultimately its best — the common sense of the common people.
In a letter to the magazine, Simon Threlkeld suggests that allotted legislative juries would be a superior alternative to plebiscites:

Referendums not ideal for public input on laws, taxes

Monday, Mike Harris tabled his Balanced Budget and Taxpayers Protection Act. The act requires the Ontario government to get public consent in a referendum vote before increasing corporate, personal, retail, gasoline and employer health taxes.
One of the basic ideas of democracy is that the government ought to carry out the wishes of the people. In a fully democratic society, government would not be able to impose laws the public does not want. Instead, the government’s laws would require public consent.
Mike Harris and his cabinet think public consent is a great idea for certain tax increases they happen to oppose. But when it comes to requiring public consent for any legislation they might support, it’s no thanks.
However, the democratic approach is for all laws to get public consent, not just those hand-picked by a particular government.

Three Irish political scientists, David Farrell, Clodagh Harris and Jane Suiter, write in the Washington Post:

On May 22, Ireland became the first country in the world to introduce marriage equality through a national referendum to change the country’s constitution.
The vote was a world first in one other sense: Never before has a country changed its constitution as a result of deliberation involving a random selection of ordinary citizens. The government’s decision to call the referendum came because of a recommendation from the Irish Constitutional Convention, which had been asked to consider a range of possible constitutional reform questions.

Following the rejection of the Icelandic citizens’ jury’s conclusions on constitutional reform, it is disappointing to report that much the same has happened in Ireland:
[T]he people who were involved really cared about this thing and did everything they could to make it a model for new ways of thinking about democracy in the 21st century. There was a glimmer of hope that some kind of dignity was being restored to the political process. Instead all it’s really done is to polish up the sign on the gates of institutional democracy: abandon hope all ye who enter here.
The process showed that, given half a chance, citizens are not cynical and want to engage positively with their State. It also showed that that State, given half a chance, will make them feel like fools for wasting their time.

Citizens’ Initiative Reviews: Democracy via Vicarious Deliberation?
Although there has been much discussion in deliberative democracy circles on both the potential and possible drawbacks of “intensive” citizen deliberation–especially on Equality by Lot–there has been less awareness and discussion of deliberative forums in practice. Below is a video interview (first 16 minutes only) of two panelists from last fall’s Citizens’ Initiative Review pilot in Colorado. Further below, you will find links to two peer-reviewed articles evaluating the 2010 CIR in Oregon. Oregon is, to my knowledge, the unique contemporary example of a permanent incorporation of citizen deliberation into its political system. The link at the end of the post is to Oregon’s CIR Commission and to the Oregon Statutes that govern it.

A new Spanish political party called “Podemos” (“we can”) has seen meteoric growth in public support according to opinion polls. According to some polls, it has now surpassed in popularity the two major Spanish parties.
Its founding manifesto (a somewhat awkward translation here) presents Podemos as an outgrowth of the 2011 “Indignados” protests and the unrepresentative nature of the existing system:
Turning outrage into political change
Just as with other moments in history, we see today a European continent submerged in perplexity. Whilst the majorities look back with nostalgia on the past that is lost, certain powerful minorities, with no criterion other than their own survival, show that enrichment is their flag and impunity their horizon. Never in Europe have there been so many people discontented with their loss of rights, and, at the same time, so few prospects for channeling this outrage through a voting option that excites while at the same time, shows the capacity to represent the majorities under attack and a capacity for committed and efficient administration that makes the best possible options become real. Many find it intolerable that in the greatest crisis in the system since the crash of 1929, those forces that claim to be progressive are at their weakest point, thereby condemning the majorities in our countries to a kind of melancholy that leads to resignation and political depression. Morrison Institute hosts citizen’s initiative review to help inform Arizona voters

ASU’s Morrison Institute for Public Policy partnered with Healthy Democracy to host Arizona’s inaugural citizens’ initiative review, which discussed pension reform among a small group of residents Sept. 18-21.
Arizonans will vote on Proposition 487, which favors a shift from public direct benefit systems, to private defined benefit pension systems, at the Nov. 4 election. The CIR brought together 20 randomly selected Phoenix voters of various backgrounds to learn about the different sides of the issue and create an unbiased resource for voters.

The Sunday Times has published a pull-out on the Scottish Referendum and asked Vernon Bogdanor (David Cameron’s politics tutor at Oxford, now professor of government at King’s College London and the UK’s leading constitutional expert) to examine the consequences of the Referendum for the rest of the UK. Here’s an excerpt from his article:
The Next Question: Should England have a new Magna Carta?
Here is one suggestion. The Scottish referendum has released a hitherto submerged civic spirit, especially among younger voters. That spirit could also be tapped in England.
Suppose a small proportion of councillors — say 5% or 10% — were to be selected randomly by lot from the electoral register. Those chosen could refuse to serve, but most would probably do so and would include the young and members of ethnic minorities, groups markedly underrepresented in local government.
Those selected would be genuine independents, deciding what was best for their communities without being beholden to party. They would undergo a valuable form of civic education with beneficial consequences for local democracy. Local government could begin once again to become representative government.
Bogdanor reviewed both of my books on sortition — the first time (The Party’s Over) quietly ridiculing it and the second time (A People’s Parliament) agreeing that sortition is something that should be investigated at the local level.
