If the legislature is (at least partly) chosen by lot – how to restructure the executive branch?

Terry Bouricius and I are working on some ideas for reforms to the executive branch that would be compatible with an allotted legislature. We have a paper in peer review on some aspects of this, and we’re working on a second paper that would be more comprehensive.

The sortition literature that we’ve read is mostly limited to the legislative branch. The two main exceptions we know of are Keith’s book “A People’s Parliament,” and John Burnheim’s book “Is Democracy Possible.”  Does anyone here know of other books or papers that deal with the question of “what to change in the executive branch, assuming that the legislature is at least partially selected by lot?”

Alex Guerrero: Against Elections

Alex Guerrero has a new paper forthcoming: “Against Elections: The lottocratic alternative”.

The paper begins as follows:

It is widely accepted that electoral representative democracy is better — along a number of different normative dimensions — than any other alternative lawmaking political arrangement. It is not typically seen as much of a competition: it is also widely accepted that the only legitimate alternative to electoral representative democracy is some form of direct democracy, but direct democracy — we are told — would lead to bad policy. This article makes the case that there is a legitimate alternative system — one that uses lotteries, not elections, to select political officials — that would be better than electoral representative democracy.

Philo Judaeus advises against sortition

Philo Judaeus was a Hellenistic Jewish philosopher who lived in Alexandria, in the Roman province of Egypt, in the first century BC and first century AD. The following passages are taken from Philo’s A Treatise on Those Special Laws Which Are Contained Under and Have Reference to the Eighth and Ninth, and Tenth Commandments.. In them he repeats the competence argument against sortition which Xenophon attributes to Socrates. Philo adds an argument against sortition and in favor of elections from Biblical authority.

(151) Some persons have contended that all magistracies ought to have the officers appointed to them by lot; which however is a mode of proceeding not advantageous for the multitude, for the casting of lots shows good fortune, but not virtue; at all events many unworthy persons have often obtained office by such means, men whom, if a good man had the supreme authority, he would not permit to be reckoned even among his subjects: Continue reading

Looking for co-presenter on sortition in Washington

The National Coalition on Deliberation & Dialogue is holding its annual meeting in Washington, 17-19 October.

They ‘highly encourage’ two presenters.

I’d be interested in focusing on the cultural aspect of switching from electoral campaigns to sortitional selection. Especially how media might be used. Encouraged by NCDD’s suggestions, I might devise an on-the-spot exercise for participants.

I would assume that a co-presenter would concern her- or himself with the more conceptual aspects.  But maybe not. Maybe doubling up on the “How?” would be best.

Manuel Arriaga: Rebooting Democracy

A review of Manuel Arriaga’s Rebooting Democracy: a citizen’s guide to reinventing politics

Rebooting Democracy is a short and enjoyable book (available at Amazon; the first 50 pages are available online). Its introduction explicitly positions it as being motivated by the sentiments of the Occupy protests and the author’s proposals as responding to those sentiments. Like the Occupy protests Arriaga’s message is to a considerable extent anti-electoral:

[V]oting out one politician or party to bring in a different one will not solve our problems. Time has made it clear that this is not merely an issue of casting. If the play stinks, replacing the actors will not make it any better.

The first two chapters present an explanation of why the Western electoral system does not serve “us”. Arriaga summarizes his explanation with the following two points:

1) We have delegated power to the political class and hardly supervise it.

2) As voters, we are condemned to unreflective and easy-to-influence decision-making. Even if we were inclined to effectively supervise politicians, this would severely limit our ability to do so.

Presidential Selection by Lottery?

The latest on sortition from Italy. Not sure I see the advantage of having the head of state selected by sortition, and equally unsure why it should be so important to exclude anyone from the draw for such a (largely ceremonial and apolitical) post. More consideration of these topics seems appropriate.

Democratic accountability, part 2

Part 1 describes what “democratic accountability theory” is.

“Accountability” has a generalized positive connotation. Surely it is better when power is held accountable than when it is unaccountable or arbitrary. Scratching the surface, however, various considerations make it evident that the appeal of “electoral accountability” is illusory.

  • First, an “accountable government” is presumably self-evidently superior to an “unaccountable government” whose mandate is permanent and therefore cannot be replaced. But the charm of accountability seems less clear when the alternative is a different “unaccountable” government – a government whose mandate is temporary and cannot be renewed. If elections are the only method of accountability then such a limited mandate government is not accountable either. Accountability, it turns out, is not about replacing government any more than it is about permanent government. For some reason, a government must be re-electable to be “accountable”. It is the ability to award the prize of re-election that makes a government electorally accountable. If a prize cannot be awarded, or cannot be withdrawn, the spell of accountability is nullified.

Benet Brandreth proposes selecting the legislature by lot

In a 13 minute speech on BBC Channel 4 radio,

Benet Brandreth argues that our current political discourse is bankrupt, so he proposes a novel solution: a legislature by lot.

Below is my summarized transcript of Brandreth’s talk:

  1. Important things are difficult to understand. They can’t be debated using Facebook comments. They require thought, consideration, research.
  2. Political rhetoric is no longer about persuasion or debate of the issues but cheerleading. This is a symptom and a cause of a fundamental failing of our system of democracy.
  3. The politician doesn’t wish to persuade people but to say something that is pleasing.

Belgiorno-Nettis: Forget democracy, we need a new way to govern

Luca Belgiorno-Nettis writes in The Age against elections. Here is an excerpt:

[S]uggesting elections are the problem is tantamount to sacrilege. In all the theatre of our media-driven, political drama, we’ve lost sight of the original and true genius of democratia: the jury. Today, we worship a seducer and an impostor – “a poll dancer” – twisting and teasing, writhing and squeezing.

In 2005, James Spigelman, the then chief justice of NSW, had this to say about elections and the jury: “The jury is a profoundly democratic and egalitarian institution. Selection by lot has two distinct advantages. First, it operates on the principle that all persons to be selected are fundamentally equal and that, in the relevant circumstances, it is invidious to say that one person is more qualified than another. Secondly, selection by lot prevents corruption of the system.”

With the help of research colleagues, we have been investigating better models of government: all based on the jury. The jury, in our view, is more representative, more deliberative and, surprisingly, more effective. We’ve done several projects that prove this over the last few years.

The Warm, Fuzzy Side of Sortition: When Deliberation Goes Right

Has anyone read Tom Atlee’s Empowering Public Wisdom: A Practical Vision of Citizen-Led Politics? Chapter 5 is called “Citizenship and Randomly Selected Ad Hoc Mini-Publics.”

Tom’s been an advocate of sortition for decades and it seems there hasn’t yet been a discussion of his thought on Equality by Lot. Beyond being a long-time advocate of “Citizen Deliberative Councils” and other sorts of minipublics, he has deep insights into group dynamics—the conditions under which groups go beyond simple bargaining and reach something closer to creative wisdom.

In my humble opinion, there’s an inadvertent academic bias on this blog that leaves out significant work from activists and non-academic writers like Tom. I think it would serve us well to do otherwise.

To that end I will list some brilliant ideas I’ve gleaned from his latest book, Empowering Public Wisdom (2012), and from reading some of his blog.
